Senator Elizabeth Warren (D., Mass.) Spoke out in favor of the court’s build-up on Wednesday, writing in an essay for the Boston Globe that it would approve the addition of four or more seats to the nine-seat Supreme Court.
In the essay, Warren noted that a majority of the Court’s justices “signaled their willingness to overturn one of the Court’s most important decisions in the past century, threatening to eliminate Roe vs. Wade and a person’s right to choose.
She argued that this was not the first time that this “extremist court has threatened, or outright dismantled, fundamental rights in this country,” saying the court’s conservative majority has issued a series of rulings that diverge. “Both fundamental principles of law and widely recognized principles. public opinion.”
“With every move, the court shows why it is important to restore America’s confidence in an independent judiciary that is committed to the rule of law,” Warren wrote. “To do this, I think it’s time for Congress to once again use its constitutional authority to increase the number of Supreme Court justices. I do not come to this conclusion lightly or because I do not agree with a particular decision; I come to this conclusion because I believe that the current tribunal threatens the democratic foundations of our nation.
Warren then accuses Senate Minority Leader Mitch McConnell of “hijacking” the Supreme Court.
“First, in 2016, he organized the theft of a seat, breaking with long-standing precedent by refusing even a hearing for President Obama’s highly qualified candidate, ”she wrote. “Four years later he reached new heights of hypocrisy when he reversed direction – break his own “rule” prohibiting judges from voting in an election year – to pass Judge Amy Coney’s confirmation Barrett only days ahead of President Biden’s election. This packaging of the Republican courts has undermined the legitimacy of every action taken by the current court. “
“This extremist court has shown that it is not interested in advancing the fair administration of justice. It is time to rebalance the Supreme Court to create one that is.
Warren’s rant comes a week after a commission trained by President Biden to study potential reforms of the United States Supreme Court voted unanimously to approve a final report that takes “no position” on the court process.
The panel, which Biden formed in April to study the expansion and reform of the court, voted to send a nearly 300-page report report to the President who makes arguments for and against the training of judges, term limits and other High Court matters, but does not provide any recommendations.
“Like the wider public debate, there is deep disagreement among Commissioners on these issues,” the report says. “We present the arguments in order to fulfill our mission of providing a comprehensive account of the contemporary debate on court reform. “
The final report follows the release of draft documents detailing the panel’s discussions in October, in which the commission warned that increasing the number of judges on the court would be seen as a “partisan maneuver”.
Warren noted that “some oppose the idea of expanding the courts” and that opponents have argued that the expansion is a stack of courts that “starts an endless cycle of adding judges to the bench. , and that this would undermine the integrity of the tribunal ”.
“They are wrong,” she wrote. “And their concerns do not reflect the seriousness of the Republican hijacking of the Supreme Court.”
